PLEASE READ THESE TERMS OF USE (“Terms”) CAREFULLY BEFORE USING THE SERVICES PROVIDED BY BIDHIVE ACADEMY VIA OUR WEBSITE (the “Service”) OPERATED BY BIDHIVE PTY LTD (“Bidhive”, “we”, “us”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, then you are prohibited from using the Service.

Course Enrolment Agreement

When enrolling in a course with Bidhive Academy:

You agree to pay the course fees (inclusive of GST, if applicable) for the course using the payment method outlined on the enrolment form.

You understand that full payment is required even if the course is not completed.

  • Enrolment is deemed complete once you have received a username and password, and payment has been processed.
  • The duration of the course commences from the date when eLearning access to materials is granted.
  • You must confirm your account within 24 hours to ensure your enrolment is secure. Accounts not accessed within this time may be removed to accommodate other users.
  • Discount codes and special offers must be applied at the time of enrolment and cannot be retrospectively added.
  • Fees paid are non-transferable to other participants.
  • Course completion and certification are contingent on the full payment of fees and satisfaction of academic requirements.

 

Intellectual Property and Course Material

The Service and all content, materials, and intellectual property rights associated with our learning courses remain the exclusive property of Bidhive Pty Ltd. Reproduction, copying, or any form of duplication of course materials without express written permission is strictly prohibited unless provided for in specific terms within the coursework.

 

Withdrawal, Transfers, and Refunds

Bidhive Academy adheres to the Australian Consumer Law in relation to refunds. No refund is required if you simply change your mind.

Refunds may be considered under extenuating circumstances if:

  • Cancellation occurs before course commencement, and no resources have been accessed.
  • No assessment work has been saved or submitted.
  • A written request with valid reasons for cancellation is received within 7 days of course commencement.

Transfer requests require written explanation and must be made within 14 days of course commencement. Transfers are subject to approval and fees.

 

Student Conduct

Students are expected to conduct themselves in a professional and respectful manner, abstain from any harassment, discriminatory or abusive behaviour.

 

Limitation of Liability

To the fullest extent permitted by law, Bidhive disclaims liability for any indirect or consequential loss, as well as liability arising from the unlawful or negligent acts of third parties.

 

Governing Law

These Terms are governed and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any disputes arising will be subject to the exclusive jurisdiction of the courts of Australia.

 

Changes to Terms

We reserve the right to modify these Terms at our discretion. Should an amendment constitute a material change, we aim to provide at least 30 days’ notice when possible.

By continuing to use our Service after revisions become effective, you agree to the revised terms.
